The Last Will and Testament of Evan Owen


EVAN OWEN: Will filed May 20th 1861

I Evan Owen of Greene County, In the State of Indiana, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made.

First, I direct that my body is decently interred and that my funeral be conducted in a manner corresponding with my estate and situation in life. And as to such worldly estate as it has pleased God to intrust me with I dispose of the same in the manner following, Towit.

I direct first that all my just debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come to the hands of my executors from any portion of my estate.

Secondly, I direct that my personal property (not otherwise disposed of) be sold by my executors at private sale for the cash in hand, next after paying my funeral expenses and just debts, I direct that there be paid to my beloved daughter Martha Allen the sum of one hundred dollars by my said executors and that they also pay to my beloved daughter Permelia Beem the sum of eighty-five dollars.

And, I hereby will and bequeath to my beloved son, John C. Owen, one bedstead, feather bed and bedding and one bay two year old colt, now on the farm, saddle and bridle. Also one cow and calf; five head of sheep; all of my farming implements; one wagon and wagon harness.

I also hereby will and bequeath to my beloved niece Amanda Jessup, the following property, Towit. One horse; saddle and bridle; one cow and calf; one bedstead and bedding; my bureau and clothes press. I also direct that my son John C. Owen take care of the said Amanda's property until she shall arrive at the age of eighteen years, unless she should sooner marry, then he shall deliver the above named property to the said Amanda. But in case the said Amanda should die before she should arrive at the age of eighteen years or without heirs of her body, then I direct that the above named property be divided equally among my several heirs.

The remainder of my personal estate I hereby will and bequeath unto my beloved Priscilla Owen in case she should survive me. I also direct that there be paid to my beloved Grandson, John Wesley Calvert, the sum of two hundred and twenty- five dollars on his arriving at the full age of twenty-one years (by my son John C. Owen). But in case the said John Wesley Calvert shall die before he shall arrive at the age of twenty-one years, then I direct that the said two hundred and twenty-five dollars be equally divided between my several heirs.

And, I hereby make and ordain my worth and beloved son Charles G Owen and John C. Owen executors of this my last will and testament.

In witness whereof, I Evan Owen, the Estator, have hereunto set my hand and seal this 16th day of May, one thousand eight hundred and sixty.
